SMS Terms of Service
By using the Mason platform and its SMS features, you agree to receive text messages related to property management operations, maintenance updates, and resident communications. Message and data rates may apply. You may opt out at any time by replying STOP to any message. For help, reply HELP or contact us at hello@thisismason.com.
1. Service Description
Mason (“the Service”) is an AI-powered property management platform operated by Enduring Labs, Inc. The Service provides tools for automating property management workflows, including maintenance coordination, resident communication, vendor management, and operational analytics. The Service integrates with third-party property management software to enhance and automate existing processes.
2. Access and Authorization
Access to the Service is granted on a subscription basis. Each authorized user must maintain unique login credentials. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Enduring Labs immediately of any unauthorized use of your account or any other breach of security.
3. Data Processing and Privacy
The Service processes property management data, including resident information, maintenance records, financial data, and communication logs. All data processing is conducted in accordance with our Privacy Policy and applicable data protection laws. We implement industry-standard security measures to protect your data and the data of your residents.
4. Security Measures
Enduring Labs maintains administrative, technical, and physical safeguards designed to protect the security, confidentiality, and integrity of personal data processed through the Service. These measures include encryption of data in transit and at rest, regular security audits, access controls, and employee training on data protection best practices.
5. Service Availability and Support
We strive to maintain 99.9% uptime for the Service. Scheduled maintenance windows will be communicated in advance. Support is available via email at hello@thisismason.com during business hours. We will make commercially reasonable efforts to respond to support requests within one business day.
6. User Obligations
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not: (a) use the Service in any way that violates applicable laws or regulations; (b) attempt to gain unauthorized access to any part of the Service; (c) interfere with or disrupt the integrity or performance of the Service; (d) attempt to reverse-engineer or decompile any portion of the Service.
7. Intellectual Property Rights
The Service, including all software, algorithms, user interfaces, designs, and documentation, is the exclusive property of Enduring Labs, Inc. and is protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service during the subscription term. You retain all rights to your data uploaded to or processed by the Service.
8. Limitation of Liability
8.1 Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8.2 Limitation of Damages
In no event shall Enduring Labs be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
8.3 Cap on Liability
Enduring Labs' aggregate liability for all claims relating to the Service shall not exceed the total amount paid by you to Enduring Labs during the twelve (12) months immediately preceding the event giving rise to the claim.
8.4 Exceptions
Nothing in these Terms shall limit or exclude liability for (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability which cannot be excluded or limited under applicable law.
9. Term and Termination
These Terms are effective upon your first use of the Service and remain in effect until terminated. Either party may terminate the subscription with thirty (30) days' written notice. Enduring Labs may suspend or terminate your access immediately if you breach these Terms. Upon termination, your right to use the Service ceases and we will make your data available for export for thirty (30) days, after which it may be deleted.
10. General Provisions
These Terms constitute the entire agreement between you and Enduring Labs regarding the Service. If any provision is found unenforceable, the remaining provisions shall remain in effect. Our failure to enforce any right or provision shall not be deemed a waiver. These Terms are governed by the laws of the State of California without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.
